You do not need every document before asking questions, but gathering these items early helps the title company, attorney, heirs, and buyer understand what can close and when.
Documents to gather
- Death certificate
- Letters testamentary, letters of administration, or court appointment paperwork
- Will, trust, beneficiary deed, transfer-on-death deed, or estate documents if available
- Most recent deed and property tax bill
- Mortgage, HELOC, HOA, lien, utility, or judgment payoff information
- Insurance policy and vacant-property coverage details
- Lease, tenant ledger, rental license, or property management records if occupied
- Repair bids, code notices, permits, or inspection reports
- Photo inventory of personal property the family wants to keep
- Contact list for heirs, attorney, title company, and advisors
Title will verify authority
The title company needs to confirm who can sign, what liens must be paid, and whether court orders or estate documents are required before closing.
Family clarity matters
Share document status, repair notes, offer terms, and estimated proceeds with the same group of heirs so everyone is working from the same facts.
